Permesso di soggiorno per motivi di lavoro is a type of residence permit granted to foreign nationals who intend to work in Italy. It is divided into two main categories:
- Lavoro subordinato — employment under an Italian employer;
- Lavoro autonomo — self-employment (freelance, entrepreneurship, Partita IVA, etc.).

- D.Lgs. 25 luglio 1998, n. 286 (Testo Unico Immigrazione) — Arts. 5, 22, 26;
- D.P.R. 31 agosto 1999, n. 394;
- Decreto Flussi — now a triennial quota decree (D.P.C.M. 2 ottobre 2025, covering 2026–2028), replacing the previous annual system;
- D.L. 146/2025 — increased the deadline for signing the contratto di soggiorno and submitting the application from 8 to 15 days;
- D.L. 10 marzo 2023, n. 20 (Decreto Cutro), conv. Legge 50/2023 — conversion from study permit to work permit is now outside quota limits (fuori quota);
- Codice Civile and Codice del Lavoro (Statuto dei Lavoratori).

I. Permesso di soggiorno per motivi di lavoro subordinato
Eligibility
- Foreigners who entered Italy with a type D visa and hold a valid nulla osta;
- Foreigners already residing in Italy under a permesso eligible for conversion.
Procedure
- The employer submits a request for nulla osta through the SUI (Sportello Unico Immigrazione);
- Once approved — application for a type D visa at the Italian consulate in the country of origin;
- Entry into Italy with the type D visa;
- Signing of the contratto di soggiorno within 15 days of arrival (D.L. 146/2025);
- Submission of the application package through Poste Italiane (kit);
- Appointment at the Questura for photos and fingerprints;
- Collection of the permesso at the Questura.

Applications are submitted online via portaleservizi.dlci.interno.it within the quota limits of the Decreto Flussi (triennial, 2026–2028).

Types of Work Covered
- Standard employment (companies, bars, factories, etc.);
- Seasonal work — up to 9 months (agriculture, tourism);
- Domestic work, family assistance (caregivers, cleaners);
- Work under Decreto Flussi programs.
Some categories (self-employed, Blue Card, highly qualified) are exempt from quotas, but nulla osta is still required.

Submission Timeline
⚠️ Updated: Within 15 days of entering Italy with a type D work visa (D.L. 146/2025; previously 8 working days), the applicant must sign the contratto di soggiorno at the SUI and submit the application via Poste Italiane.
By law, the decision must be issued within 20 days of submission. In practice, processing takes 6–12 months, especially in large cities. The ricevuta (receipt) grants legal status during the waiting period.
Validity
- Up to 1 year — fixed-term contract (contratto determinato);
- Up to 2 years — permanent contract (contratto indeterminato).
Renewal applications must be submitted at least 60 days before expiry. Maximum 3 consecutive years per renewal cycle.

Permesso di soggiorno per lavoro autonomo is granted to foreigners who wish to work in Italy independently: running a business, practicing a craft, freelancing, creative work, providing services, etc.

- Register a Partita IVA with an ATECO code;
- Have a minimum income sufficient for living expenses (≥ €7,101.12/year in 2026 — Circ. INPS 153/2025);
- Register with INPS;
- Proof of housing (rental contract or dichiarazione di ospitalità);
- Criminal record clearance.

The work permit can also be obtained by converting from another type of permesso (family, study, seasonal).
Conditions
- Valid permesso eligible for conversion;
- Signed employment contract or active Partita IVA;
- Available quotas under Decreto Flussi (if required);
